Fort Lauderdale Personal Injury Protection Litigation

Personal Injury Protection Coverage (PIP) is insurance coverage that is required of every driver who owns and operates a car or truck in the State of Florida. PIP will pay any personal injuries arising from the accident up to the limits of the policy, regardless of who was at fault in the accident. PIP coverage must be a minimum of $10,000 and it covers 80% of the insured’s medical bills, 60% of their lost wages up to $10,000, and death benefits of up to $5,000 of unused PIP benefits. Typically, PIP benefits are available for named insureds and their resident family members.

The law is also very specific on when the claims for reimbursement are to be paid. PIP benefits must be paid within 30 days of submission. Therefore, if insurance companies refuse to pay the PIP benefits or attempt to reduce portions of the PIP benefits covered under Florida Statutes §627.736, a PIP suit can be filed by the insured or by the medical provider on behalf of the insured.
